Preempt Health, Inc. (“Preempt”) strives to protect the privacy of your information and provide a safe and secure environment for you. This privacy policy (“Policy”) is intended to provide you with information on how Preempt gathers and uses information about you.

By visiting, accessing, or using Preempt websites (“Sites”) or the Preempt services (“Services”), you are accepting the policies and practices described in this Policy. Each time you visit, access, or use Sites or Services, you agree and expressly consent to our collection, use and disclosure of the information that you provide as described in this Policy. As the Internet is always evolving, Preempt reserves the right to update this Policy from time to time. Your use of any of Sites and/or Services following an update of the Policy shall be deemed your acceptance of such changes. You agree to review the Policy periodically to be aware of such modifications and your continued access or use of Sites and/or Services shall be deemed your conclusive acceptance of the modified Policy.

  • Types of Information.

In this Policy, the term “Personal Information” means information about you that is personally identifiable, like your name, address, e-mail address, or phone number, health information, as well as other non-public information that is associated with this information. The term “Anonymous Information” means information that is not associated with or linked to your Personal Information. Anonymous Information cannot be used to identify you individually.

Preempt collects information about you in three ways: (i) information you voluntarily provide to Preempt in order to obtain access to Sites or Services (e.g. when you register for Sites or Services, you may provide Preempt certain information including your name, e-mail address, screen name, password, demographic information, and answers to questions Preempt uses to provide you with a customized exercise program, like your body measurements, height and weight, and/or your current method of exercise); (ii) information Preempt collects about you through your use of Sites or Services (i.e. as you use Sites and Services, certain information may also be passively collected through technologies like cookies, pixels, beacons and log files, for example, Preempt may determine through your IP address that you are located in Minneapolis, Minnesota and Preempt may deliver advertisements promoting Minneapolis based-businesses.); (iii) information Preempt receives from third parties (e.g. Preempt may use your e-mail address to determine your street address or Preempt may use your street address to obtain demographic information about you or the 9-digit ZIP code (ZIP+4) where you live).

  • How Preempt Uses Information.

Preempt uses Personal Information and Anonymous Information, in part, to provide you with the requested Sites and/or Services. Preempt also uses your Personal Information and Anonymous Information as necessary or appropriate, in part, to personalize and better tailor the features, performance, and support of Sites and/or Services for your use and to improve the quality of Sites and/or Services. The information is also used to analyze, benchmark, and conduct research on user data and user interactions with Sites and/or Services as well as for our other business needs.

Preempt may send you offers or promotional communications from Preempt. At that time you will have the opportunity to ‘opt out’ by following the unsubscribe instructions provided in the promotional e-mail or newsletter you receive or by editing your preference to receive these communications within the unsubscribe link or similar feature on Sites. Please note that despite your indicated e-mail preferences, Preempt may send you administrative e-mails regarding Sites and/or Services, including, for example, administrative confirmations and notices of updates to our Policy if Preempt choose to provide such notices to you in this manner.

Preempt may disclose your Personal Information and Anonymous Information to third parties. For example, Preempt may disclose and release your Personal Information to third parties in order to comply with valid legal requirements such as a law, regulation, search warrant, subpoena, or court order or for other situations Preempt determines to be an emergency. Personal Information may also be shared with third party service providers who work on our behalf or help Preempt to operate our business, Sites and Services. As Anonymous Information does not allow you to be personally identified, this information will be shared with third parties as Preempt deems appropriate. Anonymous Information shall be owned by Preempt and Preempt may distribute such aggregate information to third parties in its sole discretion.

When you place an order for or subscribe to Sites and/or Services, Preempt needs to know certain information that is typically used for credit card transactions, such as your name, mailing, billing, and shipping address, telephone number, credit card number and expiration date. If a third party provides credit card information on your behalf, Preempt will collect this information about you as well as the credit card holder.

If your Personal Information changes or if you no longer desire to use or access one of Sites and/or Services, Preempt encourages you to correct, update, or remove the Personal Information from your profile on Sites. Even if you delete information from your profile, Preempt may retain your Personal Information in conformance with our data retention policy and there may be residual Personal Information that remains within our databases, access logs, and other records. In addition, Preempt is not responsible for updating or removing your Personal Information contained in the lists or databases of third parties who have been provided information as permitted by this Policy.

  • Submissions by You.

Message boards, chat rooms, and other interactive forums may be available as part of Sites and/or Services. You should be aware that any information that you post to these interactive forums or otherwise choose to make publicly available, including your Personal Information, may be disclosed and available to all users who have access to that portion of Sites and/or Services, and is therefore no longer private. By using these interactive forums, you agree that Preempt is not responsible for any information that you disclose or communicate in such forums, and any disclosures you make are at your own risk. Additionally, you are fully responsible for all information posted in these interactive forums.

  • Use by Individuals 13 and Older.

Sites and Services are not directed or intended for individuals under 13 years of age. Preempt does not knowingly collect Personal Information from individuals under 13 years of age. If you are under 13 years of age, you should not register or provide Personal Information on Sites or through Services. If Preempt later obtains actual knowledge that you are under 13 years of age, Preempt will take steps to remove your Personal Information from our systems. If a parent or guardian of a child under 13 years of age becomes aware that the child under 13 years of age has disclosed Personal Information to us, please contact Preempt at so that Preempt may delete and remove such child’s information from our systems.

  • Linked Sites.

Preempt may link to other web sites. Preempt provides these links as a convenience, but we neither control nor endorse these linked sites. These sites may collect user information or solicit personal information. Since Preempt does not control these sites we are not responsible or liable for the privacy practices or content of such sites.

  • Use of Cookies.

Preempt may also have agreements with companies, sometimes called “Ad Companies”, which advertise on Sites on behalf of third parties. These Ad Companies may place or recognize a unique cookie, sometimes called a ‘third-party cookie’, on your browser. Ad Companies use cookies to understand Preempt usage patterns of people who see advertisements, to control the sequence of advertisements you see, to provide you with the most relevant advertising, and to make sure you do not see the same ad too many times. Ad Companies may connect information about pages you visit on our site with information about pages you visit on other sites and show you advertising based on this combined information. Preempt does not control Ad Companies or what they do with the information they collect.

  • Sales or Mergers.

It is possible that Preempt and/or any of our assets may be acquired by an unrelated third party. In such a transaction, as the owner of this customer information, we may disclose or sell the information as an asset of the company in conjunction with the sale of our company or the sale of a portion of our assets to a third party. While we will endeavor to require the successor company to maintain this privacy policy, we cannot guarantee that our policy will remain in effect.

  • Security Policy.

Preempt places a priority on the security of Personal Information and Preempt undertakes industry-standard security measures to protect the data that resides on our servers. However, no security system is impenetrable. Preempt is committed to protecting your personal information. Preempt stores information you provide us on secure servers. Further the information you provide when providing credit card information is encrypted with SSL technology. NOTWITHSTANDING THE FOREGOING, PREEMPT DOES NOT WARRANT THE SECURITY OF OUR SERVERS, NOR DOES PREEMPT WARRANT THAT YOUR INFORMATION, INCLUDING PERSONAL INFORMATION, WILL BE COMPLETELY SECURE OR NOT BE INTERCEPTED WHILE BEING TRANSMITTED OVER THE INTERNET.

  • Jurisdictional Issues.

Preempt is controlled, operated, and administered by Preempt from its offices in the United States. Preempt makes no representation that Services, Sites, or the material or content on Services or Sites are appropriate or available for use at other locations outside of the United States. You may not use Services or Sites in countries or territories where Services or Sites are illegal or prohibited. You may not use Services or Sites if it is in violation of United States export laws, policies or regulations. Further, by accessing Sites or Services, you acknowledge and agree that your personal information may be processed for the purposes identified in this Agreement and the Privacy Policy. In addition, this information may be stored outside your resident jurisdiction and in jurisdictions that may have less stringent privacy practices than your own. By providing Preempt with this information, you consent to the Agreement and Privacy Policy.
